Jim Pillen (D) of Nebraska convened a special legislative session to identify ways to reduce state property taxes, and one of the topics on the agenda was the legalization of online sports betting. LB 13 was submitted on July 25 by Sen. Eliot Bostar (D-29) in an effort to allow online sports betting in the State of Nebraska. On Wednesday, July 31, the General Affairs Committee will hold a hearing on the bill.
Although it began accepting bets on sports in person at state casinos in 2021, Nebraska only authorized sports betting online in June of 2023. The recently proposed bill will let casinos provide online sports betting to citizens of Nebraska via their own platforms or by collaborating with an operator. The Nebraska Racetrack Gaming Act is amended by Bostar’s bill to permit casinos to provide online sports betting. Bostar dedicates the majority of the online sports betting tax earnings, as stipulated under the presented legislation, to reducing state citizens’ property taxes.
“The legislature finds that Nebraska relies more heavily on local property taxes to support public education compared to other states and consistently ranks in the top ten among all states in terms of per capita property tax burden on its citizens. The legislature further finds that is important to authorize and impose a tax upon the gross gaming of sports wagering by means of an online sports wagering platform in order to create a property tax relief program to reduce the tax liability of property taxes paid to support public education,” he wrote in the bill.

A total of 90% of the tax proceeds from online sports betting will go toward funding the Property Tax Credit Cash fund, which will help Nebraskans with their property taxes. Presently, the property tax fund receives 70% of the tax revenue from in-person sports betting, which is taxed at a rate of 20% of gross sports betting revenue.
A compulsive gamblers support fund would receive 3% of the remaining sports betting tax income, while the Racetrack Gaming Fund and the Racing Cash Fund of the Racing and Gaming Commission would get 3.5% and 3.5% of the proceeds, respectively. Additionally, his plan permits collegiate prop bets on teams and people and removes the ban on sports wagering on in-state universities.
Bostar also proposed LR3CA, which would give state voters the final say over any legislation legalizing online sports betting. In order to legalize online sports betting, the legislative resolution would need a constitutional amendment, which would need to be accepted by three-fifths of the Nebraska legislature and then by the majority of state voters in the November election.
There are several bills pertaining to sports betting that were introduced during the special session besides Bostar’s measure. On July 26, Sen. Tom Brandt (R-32) introduced LB 32, which would permit collegiate prop bets on teams and individuals as well as sports wagering on in-state universities. Referred to the General Affairs Committee, Brandt’s bill is limited to wagers on Nebraska sports made in person.
