January 4, 2024In the months following the May 2018 repeal of the Professional and Amateur Sports Protection Act, a total of 29 US states have legalized online sports wagering. With the launch of betting apps in eight jurisdictions in 2019, the year with the highest volume of launches was followed by seven jurisdictions in 2023. At least two states will become online in 2024. Operators in Vermont are scheduled to begin operating as early as 12:01 a.m. on January 11, while the regulator in North Carolina hopes to begin operations sometime after the Super Bowl and before the summer. It’s possible that only those two states will provide mobile betting in the upcoming year.

Currently, digital betting is not available in twenty-one states, and wagering in any form is not available in twelve. Of those, a few states—like Utah, where gambling is against Mormon doctrine—may never allow sports betting. States like Idaho, Hawaii, and Alaska, however, have hardly given legalization any thought.
Furthermore, it is improbable that Texas and California, the two largest states without legalization, will legalize in 2024. Another commercial group in California might bring another ballot initiative in 2024, but the tribes have already pledged to resist it, and the Texas legislature won’t convene until 2025.
Even with retail legalization, Georgia, Minnesota, and Missouri—the next three largest states without gambling—remain far from certain. For more than three years, each of the three has been debating legalization while battling a different set of problems, and they all still have unanswered questions as 2024 approaches. New bills are being promised by legislators in Alabama, Georgia, Minnesota, Mississippi, and Missouri. However, 2024 also happens to be a year of presidential elections, so a lot of legislators—even state legislators—will be more preoccupied with politics than with policy. And all of this preparation might be in vain if the legislature of a state that is seriously contemplating sports betting were to drastically alter course in November.
It’s important to remember that Sen. Denny Hoskins of Missouri has a 2024 term limit so sports betting in Missouri could happen in 2025. Hoskins has steadfastly pushed on linking wagering to video lottery terminals. Hoskins pre-filed a bill on December 1st that would link the two, while a group of major league teams seems to be proceeding with an initiative that would allow voters to decide whether or not to legalize.
Some states are starting to look into what legal online betting or traditional betting may entail. Research conducted by the government in Mississippi looked at strategies, while a study by the Alabama Policy Institute examined the drawbacks of allowing sports betting and other forms of gambling. Wagering will be a topic of discussion when sessions start the next week. Mississippi and Missouri are among the first states to open, on January 2 and 3, respectively.
